Eligible Kelmwav lighting fixtures are covered by our 5-Year Limited Warranty, subject to the applicable warranty terms, conditions, limitations, and exclusions communicated on our Site.

Except for the express 5-Year Limited Warranty and any other warranties or rights that cannot lawfully be excluded, the Site and Services are provided on an "as available" basis.

We do not guarantee that access to the Site will always be uninterrupted, timely, secure, or error-free.

To the maximum extent permitted by applicable law, Kelmwav LLC and its directors, officers, employees, affiliates, agents, contractors, suppliers, service providers, and licensors will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the Site or products purchased through the Site, except where such limitation is prohibited by law.

Hardwired lighting fixtures should be installed by a qualified, licensed electrician in accordance with applicable electrical codes, manufacturer instructions, and local requirements.

To the extent permitted by law, Kelmwav LLC is not responsible for damage, injury, malfunction, or other loss resulting from improper installation, unauthorized modification, misuse, or installation that does not comply with applicable instructions or electrical requirements.

Indemnification

You agree to indemnify, defend, and hold harmless Kelmwav LLC and its affiliates, officers, directors, employees, agents, contractors, licensors, service providers, subcontractors, and suppliers from claims or demands, including reasonable attorneys' fees, arising from your material breach of these Terms, violation of applicable law, or infringement of the rights of a third party, to the extent permitted by law.

Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion will be deemed severed from these Terms without affecting the validity and enforceability of the remaining provisions.
